The Platform's vision is to bring you closer to your surroundings and your community, and the services offered to regular users of Moonode are generally free.
TERMS OF USE
Please read the Platform's terms of use ("Terms of Use") carefully before using or Browse Moonode. By accessing and using it, you consent to be bound by all these Terms of Use. If you do not agree with these Terms of Use, your sole remedy is to cease using the Platform immediately. These Terms of Use form a legally binding agreement between yourself and Moonode LLC, a limited liability company. Moonode LLC may, at any time and without notice, modify, supplement, or replace the Terms of Use, at its sole discretion by posting the amended terms on the Platform. Your continued use of Moonode after any modification of the Terms of Use signifies that you accept them as modified.

You may not use any meta tags or any other "hidden text" utilizing Moonode LLC's name or trademarks without the express written consent of Moonode LLC. Any unauthorized use terminates the permission or license granted by Moonode LLC. You may not: modify, copy, reproduce, or distribute the content, information, or any other element of the Platform; use the content or any element for commercial purposes or for any public display (commercial or non-commercial); transfer the content to another person or "mirror" the content on any other server. Failure to comply with the Terms of Use will automatically result in the revocation of this license. Furthermore, this license may be revoked at any time by Moonode LLC, for any reason. Upon termination of this license, any downloaded content in your possession (regardless of format) must be destroyed.
4. Refunds
Unless otherwise explicitly stated by Moonode LLC for specific services or products, all payments made for any premium services or features offered are final and non-refundable.
5. Disclaimer of Warranties
THE PLATFORM AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS PLATFORM ARE PROVIDED BY MOONODE LLC ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. MOONODE LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS PLATFORM OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS PLATFORM, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS PLATFORM IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, MOONODE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MOONODE LLC DOES NOT WARRANT THAT THIS PLATFORM; INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS PLATFORM; THEIR SERVERS; OR ELECTRONIC COMMUNICATIONS SENT FROM MOONODE LLC ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
6. Limitation of Liability
IN NO EVENT SHALL MOONODE LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (III) ANY CONTENT OBTAINED FROM THE PLATFORM; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. 7. Indemnification
You agree to defend, indemnify and hold harmless Moonode LLC, its directors, officers, employees, agents, and affiliates, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Platform; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that content submitted by you caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the Platform.
8. User Conduct
You agree not to use the Platform for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Platform in any way that could damage the Platform, services, or general business of Moonode LLC. You further agree not to use the Platform: (i) To harass, abuse, or threaten others or otherwise violate any person's legal rights; (ii) To violate any intellectual property rights of Moonode LLC or any third party; (iii) To upload or otherwise disseminate any computer viruses or other software that may damage the property of another; (iv) To perpetrate any fraud; (v) To engage in or create any unlawful gambling, sweepstakes, or pyramid scheme; (vi) To publish or distribute any obscene or defamatory material; (vii) To publish or distribute any material that incites violence, hatred, or discrimination towards any group; (viii) To unlawfully gather information about others.
9. Termination
Moonode LLC reserves the right to terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Use. Upon termination, your right to use the Platform will immediately cease. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
10. Digital Millennium Copyright Act (DMCA) Notice
Moonode LLC respects the intellectual property rights of others. If you believe that any content available on or through the Platform infringes upon any copyright you own or control, please immediately notify our Designated Copyright Agent using the contact information provided below (a "Notification"). A copy of your Notification will be sent to the person who posted or stored the material addressed in the Notification. Please be advised that pursuant to federal law you may be held liable for damages if you make material misrepresentations in a Notification. Thus, if you are not sure that material located on or linked to by the Platform infringes your copyright, you should consider first contacting an attorney.
